Employer Intentional Tort

An employer intentional tort may occur when an employee is injured because they were required to work in a job position or job situation that is so dangerous that injury or sickness is substantially certain to occur. The employer must:

  • Have knowledge of the dangerous condition
  • Allow the dangerous condition to continue to exist after it is known to them
  • Must require the employee to work in the dangerous condition
